Yuit Inc. (hereinafter referred to as the "Company") establishes the following terms and conditions for the use of "Gallery HASABON" operated by the Company.
Article 1 (Definitions)
In this Agreement, the following terms shall have the following meanings
The term "Gallery HASABON" refers to the site operated by the Company on the Internet in accordance with these Terms and Conditions, which is a system with the functions of posting information about products and services and providing products and services online.
The term "User" refers to a person who accesses Gallery HASABON.
The "Service" means the service provided by the Company to the users of Gallery HASABON in accordance with these Terms and Conditions. The content and type of the service may be changed, increased or decreased at any time at the sole discretion of the Company, and notification thereof shall be made at any time through the display on Gallery HASABON or through e-mail or other means of communication. Article 2 (Scope of Terms and Conditions)
Article 2 (Scope and Changes to the Terms)
1 These Terms of Use shall apply to the Company and the User with respect to the use of the Service, and the User shall faithfully comply with these Terms of Use when using Gallery HASABON.
2 The individual regulations separately stipulated by the Company on Gallery HASABON or by other means, and the additional regulations notified by the Company to the Users from time to time, constitute a part of these Terms. In the event of any discrepancy between these Terms and Conditions and the Individual Rules and Additional Rules, the Individual Rules and Additional Rules shall take precedence.
3 The Company may change the Terms of Use at its sole discretion without the consent of the User. In this case, the terms and conditions of use of the services provided by Gallery HASABON shall be based on the changed terms of use. Such changes will take effect at the time of notification by e-mail to the address provided in advance, general posting on Gallery HASABON, or other methods deemed appropriate by Gallery HASABON.
4 The Company shall not be liable for any disadvantage or damage incurred by the User as a result of changes to the Terms.
Article 3 (Status of Users and Restrictions)
1 A user shall be deemed to have agreed to these Terms of Use and to have acquired the status of a user of Gallery HASABON at the same time as the user enjoys any of the services provided by Gallery HASABON (enjoyment here includes viewing information).
2 The user shall not engage in any of the following acts
(1) Use of Gallery HASABON by any means other than those specified by Gallery HASABON.
(2) Use the service by impersonating another person.
(3) Designating links to other data related to the service in a manner other than that approved by Gallery HASABON.
(4) Unauthorized access to the data stored in the computer using Gallery HASABON, or acts that may destroy or damage the data.
(5) Interfere with the operation of this service.
(6) Use of this service for business activities or commercial purposes, or use for the purpose of preparing for such activities. (6) Use of the Service for the purpose of business activities, commercial purposes, or preparations for such purposes; provided, however, that this shall not apply when otherwise approved by the Company.
(7) Collecting or accumulating the personal information of other users, or attempting to do so.
(8) Acting contrary to public order and morals, and other acts contrary to domestic and international laws and regulations.
Article 4 (Interruption and Suspension of the Service)
1 The Company may, at its sole discretion, suspend or terminate the Service in whole or in part without prior notice to Users in the event of any of the following events
(1) In the event of periodic or emergency maintenance, inspection, or updating of the equipment and systems for this service.
(2) When it is difficult to provide the Service due to force majeure such as fire, power failure, or natural disaster.
(3) When the duties of a Type 1 telecommunications carrier are not provided.
(4) In any other case where the Company deems it necessary to suspend or discontinue the Service for operational or technical reasons, or where the Company deems it difficult to provide the Service due to unforeseen circumstances.
2 The Company shall not be liable for any disadvantage or damage suffered by users or third parties due to the occurrence of temporary interruption or suspension of the provision of the Service, regardless of the reason.
Article 5 (Handling of Links)
In the event that Gallery HASABON provides links to other websites, or third parties provide links to other websites, Gallery HASABON shall not be responsible for such other websites. In such cases, Gallery HASABON is not responsible for the content, advertisements, products, services, etc. that are included in or available on such sites. The Company shall not be liable for any damages arising out of or in connection with such content, advertisements, products, or services.
Article 6 (Copyright)
1 The user shall not reproduce, sell, publish, or otherwise use any information provided through Gallery HASABON in any way that exceeds the scope of the user's personal use as defined by the Copyright Act without the consent of the right holder.
2 The user shall not allow a third party to use or publish any information provided through Gallery HASABON in any way without the consent of the right holder.
3 In the event that a problem arises due to a violation of the terms of this article, the user shall resolve the problem at his/her own responsibility and expense, and shall not cause any inconvenience or damage to the Company.
Article 7 (Liability)
1 The Company shall not be liable for any damages incurred by users or third parties in relation to the provision, delay, modification, interruption, suspension, cessation, or abolition of the Service, the outflow or burning of information, etc. provided, or any other damages incurred in relation to the Service. However, the personal information registered through this service shall be in accordance with the "Handling of Personal Information" separately stipulated.
2 In the event that a user causes damage to a third party through the use of this service, the user shall resolve the matter at their own responsibility and expense, and shall not cause any damage to the Company. In the event that a user causes damage to the Company through an act in violation of these Terms of Use, or through a fraudulent or illegal act, the Company shall be entitled to demand compensation for the damage from the user.
Article 8 (Privacy Policy)
The management and handling of user information obtained by the Company in relation to the use of the Service by users shall be in accordance with the Privacy Policy separately stipulated by the Company.
Article 9 (Governing Law)
The laws of Japan shall apply to the formation, validity, performance, and interpretation of these Terms.
Article 10 (Agreed Jurisdiction)
In the event of any dispute arising out of or in connection with this Agreement, the district court having jurisdiction over the location of the head office of the Company shall have exclusive jurisdiction in the first instance.
